Illinois Partner Obtains Favorable Decision for Transportation and Logistics Company in Workers’ Compensation Claim

Chicago Partner Jonathan Barrish recently obtained a favorable decision on behalf of our transportation and logistics client in a workers’ compensation claim before the Illinois Workers’ Compensation Commission in Will County.

The case arose from a claim filed by a trailer spotter who alleged that repetitive vibration from a spotter truck and the lifting of trailer stands aggravated a preexisting lumbar condition, causing severe low back pain and radiculopathy. The petitioner sought workers’ compensation benefits, claiming he sustained a work-related injury on July 21, 2021, and had been unable to work since that date.

Litchfield Cavo’s defense attorney argued that the petitioner failed to establish an accident arising out of and in the course of his employment. The evidence demonstrated that the petitioner had a documented history of low back pain and leg symptoms predating the alleged accident, including medical treatment and work restrictions issued before July 21, 2021. Counsel further presented medical evidence that the petitioner’s condition was the result of a longstanding congenital spinal defect and the natural progression of degenerative changes, rather than any work-related injury.

The defense also highlighted inconsistencies regarding the reporting of the alleged injury, the timing of medical treatment, and the causation evidence presented. Following the presentation of testimony and medical evidence, the arbitrator concluded that the petitioner failed to prove he sustained an accidental injury arising out of and in the course of his employment.

On May 1, 2026, the arbitrator issued a decision in favor of our client, denying the claim for benefits and finding that the evidence did not support a compensable work-related injury under the Illinois Workers’ Compensation Act.
